Terms of Service

These Terms of Service (“Terms”) govern your use of www.thefolkproject.com and any purchase from The Folk Project. By browsing the site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree, please do not use the Website or place an order.

We currently sell only within India.

2. What we sell

We sell graphic tees and blank tees. Products are sold as shown on the product page (design, colour, and size). Please use the size chart before you buy. Colours on screen can differ slightly from the fabric because of lighting and your display.

We have not set a separate made-to-order / custom-print rule yet. Until we publish one, tees are treated as standard ready-to-ship apparel under these Terms and the Refund Policy (including size exchange where the Refund Policy allows it).

3. Eligibility

You must be 18 years or older (or using a parent/guardian’s details with their permission) and able to enter a contract under Indian law. You confirm that the information you give at checkout is true and complete.

4. Orders and pricing

An order is an offer to buy. We accept it when we send an order confirmation and/or when payment is successfully captured (or when we confirm a COD order). We may cancel an order if the item is out of stock, a price or description error is obvious, payment fails, or we reasonably suspect fraud. If we cancel after a prepaid payment, we refund the amount paid to the original payment method. If we cancel a COD order before dispatch, nothing is due.

Prices are in Indian Rupees (₹). Standard shipping within India is included in the MRP shown on the product and at checkout. Cash on delivery, if you choose it, adds ₹250 (see Payment below). We may change prices at any time; the price at checkout is the price you pay for that order.

When GST registration is complete, applicable GST will appear as required on the invoice.

5. Payment

You may pay:

• Prepaid via Shopify checkout through Razorpay — UPI, credit/debit cards, and other methods Razorpay enables; or
• Cash on delivery (COD) with an extra ₹250 COD fee, collected with the order value when the courier delivers.

You authorise us and Razorpay to charge the selected prepaid method for the order total. Failed, incomplete, or reversed prepaid payments mean the order is not confirmed. For COD, the courier must be able to reach you; refused or failed COD deliveries are handled as in the Shipping Policy.

6. Shipping and risk

We ship from Coimbatore to addresses across India. Estimated delivery is 7 to 10 days from order confirmation, subject to pin code, stock, and courier conditions. The courier is chosen at dispatch. Title and risk in the goods pass to you when the courier delivers to the address you gave (or as otherwise provided under applicable law).

7. Cancellations, size exchange, and refunds

You may cancel an order free of charge before it is shipped.

After delivery, unused tees with unbroken tags may be returned or exchanged for size within 7 days, as set out in the Refund Policy. Size exchange is allowed only if the requested size is in stock and the returned tee meets the condition rules. Damaged or wrong items must be reported within 2 days of delivery.

Approved refunds go to the original prepaid payment method. For COD orders, we will refund by bank transfer / UPI to the details you provide, after we receive and inspect the return.

8. Your responsibilities

• Give a complete, reachable shipping address and phone number (required for COD)
• Check the size chart before you buy
• Keep tags attached and the tee unused if you want a return or size exchange
• Report damage or a wrong item within 2 days, with clear photos
• Do not misuse the Website, scrape it, or attempt unauthorised access

9. Intellectual property

The Folk Project name, logo, artwork on graphic tees, product photographs, text, and design of the Website belong to us or our licensors. You may not copy, sell, or commercially reuse them without our written permission. Buying a tee does not transfer copyright in the artwork.

10. Reviews and content you send us

If you send photos or reviews, you give us a non-exclusive right to use them to process your order and, where you agree, for our Website or ads. Do not send unlawful or infringing content.

11. Limitation of liability

To the extent permitted by Indian consumer law, we are not liable for indirect or consequential loss, courier delays outside our control, or minor shade differences that are normal for printed or dyed fabric. Nothing in these Terms limits liability that cannot be limited by law, including liability for proven defects we are required to remedy.

Our total liability for a product is limited to the amount you paid for that product (and the COD fee, where we charged it and it is eligible for refund).

12. Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including courier disruption, natural events, strikes, government restrictions, or system outages at Shopify, Razorpay, or the carrier.

13. Governing law

These Terms are governed by the laws of India. Courts in Coimbatore, Tamil Nadu shall have exclusive jurisdiction, without affecting any non-waivable consumer rights you have under Indian law.

14. Changes

We may update these Terms. The updated version applies to orders placed after it is published on the Website.
